Terms and Conditions:

Agreement Between Lead Provider and Mechanic

Effective Date: August 4, 2025
 Parties:

  • Lead Provider: Nationwide Mechanics
  • Mechanic/Service Provider: The Mechanic

1. Purpose of Agreement

The Company is a marketing and lead generation agency that connects customers with mobile or in-shop mechanics. The purpose of this agreement is to outline the terms under which The Mechanic will receive job leads and interact with potential clients.

2. Nature of Relationship

  • The Company only provides job leads to The Mechanic.
  • The Company is not responsible for the actions, quality of work, or conduct of The Mechanic.
  • The Mechanic is not an employee, agent, or partner of The Company. This is an independent contractor relationship.

3. Lead Distribution

  • Leads may be shared via phone, email, Google Sheets, WhatsApp, or a CRM.
  • The Mechanic is responsible for following up with the lead directly.
  • The Company does not guarantee lead conversion (i.e., a booked job or sale).

4. Responsibilities of The Mechanic

  • Provide professional, lawful, and honest automotive services.
  • Communicate clearly and promptly with the customer.
  • Handle all warranties and service guarantees directly with the client.
  • Ensure they are licensed and qualified to perform the requested services.
  • The Mechanic agrees to take full responsibility for any service performed, including potential damages, loss, or disputes arising with customers.

5. Disclaimer and Liability

  • The Company is not liable for any:
    • Service issues, damages, or losses caused by The Mechanic
    • Disputes between The Mechanic and customers
    • Payments or refunds owed by The Mechanic to any customer
  • The Mechanic agrees to indemnify and hold harmless The Company from any claims, damages, or legal actions arising from services provided.

6. Payments

  • [Specify if The Mechanic pays a fee per lead, per job, or commission-based]
  • Payments to The Company are for marketing services only, not for guaranteed jobs.

7. Termination

  • Either party may terminate this agreement with 7 days’ written notice.
  • In cases of misconduct, fraud, or complaints, The Company may suspend or permanently revoke access to leads without notice.

8. Confidentiality

  • The Mechanic agrees to keep all lead/customer data confidential and not share, resell, or misuse it.
  • Any breach will result in immediate termination and potential legal action.

9. Governing Law

This Agreement shall be governed by and interpreted under the laws of [Your State or Country].

10. Acceptance

By accepting leads from The Company, The Mechanic agrees to all terms listed in this document.
